On May 9, 2024, the U.S. Environmental Protection Agency (EPA) published the final rule to revise the Steam Electric Power Generating Point Source Category Effluent Limitations Guidelines (2024 ELG Rule). The 2024 ELG Rule sets new technology-based limitations and standards for the steam electric power generating point source category applicable to flue gas desulfurization (FGD) wastewater, bottom ash transport water (BATW), combustion residual leachate (CRL) and certain legacy wastewater at existing sources. The 2024 ELG Rule is effective on July 8, 2024.
Alabama Power Company (APC) is currently evaluating, with respect to each generating facility impacted by the rule, all compliance options and best available technologies economically achievable to comply with discharge limitations and compliance deadlines set out in the 2024 ELG Rule. APC will select the best pathway for each individual unit or facility that will ensure compliance while continuing to serve our customers with clean, safe, reliable, and affordable electricity, and continuing to protect downstream water quality and the people and wildlife that live and play in the state’s water bodies.
The 2024 ELG rule is the latest in a series of revisions to the effluent limitations guidelines that the EPA has published since 2015. In all cases, APC has worked diligently to maintain compliance with any and all requirements in these rulemakings
